Report the Injury Immediately

In order to keep your rights in a work injury situation, be sure that you report to your supervisor as soon as it happens. Not only will that give them an idea about what is going on, but it will also make it easier for you to have everything written down so that you can make your claim or go to court (that’ll depend on the next two parts that we talk about here).

Also, by reporting the injury immediately, you are less likely to end up in a situation where your work or your insurance becomes suspicious that the incident in question is actually what caused the injury. It will give your claim more solid footing, allowing you to work through the parts of your claim more quickly and with fewer roadblocks to getting things accomplished with it.

Workers’ Compensation Coverage

In almost every state (except Texas), employers must carry workers’ compensation insurance. If you use this, you are (usually) releasing your right to sue the employer for your injury or what’s going on with it. The good news is, this may even kick in if it was your own negligence that caused the accident in question. Now, that won’t happen if you were under the influence of drugs or alcohol when it happened, and there are other exceptions too, based on the insurance and the state.
